Standing Order re Sealed Depositions and Transcripts

The Court of Appeals hereby passes the following order:

All depositions filed with lower court clerks are part of that court’s record for purposes of appeals to this Court.

Original depositions shall not be transmitted to this Court. The lower court’s Index of Record on Appeal shall list all depositions included in the record.

If a notice of appeal designates that nothing is to be omitted from the record, copies of all filed depositions must be included in the appellate record, whether opened or unopened, and whether sealed by the court reporter or not. As a result, any unopened depositions that were filed in the lower court shall be opened and copied (either electronically or in a paper format), and the copies shall be transmitted to this Court as part of the appellate record.

This standing order shall remain in effect until it is superseded by further order of the Court.
